PUPPY Contract Overview

* Required for all puppy purchases*


This agreement is entered into between Dos&CoKennels, hereinafter referred to as the "Seller," located in Chicago, Illinois, and:


The undersigned party, hereinafter referred to as the "Buyer."


It is hereby mutually agreed upon by the Seller and Buyer as follows:

SELLER’S REPRESENTATIONS


The following conditions govern the sale of the aforementioned dog:


The Buyer has a grace period of FIVE days from the date of purchase to have the dog examined by a licensed veterinarian and to conduct a personal inspection. Any request for the return of the dog to the Seller must be initiated within this timeframe and must be accompanied by a written statement from a veterinarian detailing any observed issues. A warranty against genetic defects is provided for a period of two years from the date of sale, with a cumulative reimbursement limited to 50% of the purchase price. Genetic defects eligible for reimbursement include those pertaining to the hip, heart, elbow, patella, eye, or other life-threatening conditions. Reimbursement for genetic defects is contingent upon the provision of a second opinion from a qualified veterinarian and documentation of associated surgical expenses. An official OFA hip rating constitutes an acceptable second opinion. Umbilical hernia repairs are eligible for reimbursement up to $200. In the event of the rare occurrence of death, the Seller will replace the puppy free of charge if it is under 2 years of age. However, such replacement is contingent upon the submission of a necropsy report conducted by a qualified veterinarian indicating that the cause of death was attributable to a genetic issue. Shipping fees are the responsibility of the buyer. The Seller agrees to rehome the dog at the request of the original purchaser. Warranties are applicable solely to the original purchaser and become void in the event of an indeterminable or inconclusive diagnosis. The transfer of dog ownership nullifies all provisions of this agreement. The Seller makes no guarantee regarding shedding or allergic reactions caused by the dog. The Buyer acknowledges that predictions regarding coat type, height, and weight at adulthood are estimations based on the Seller's objective of matching puppies with appropriate families.


Dos&CoKennels provides a certificate for 30 days of complimentary health insurance through Trupanion. Activation of this coverage is the responsibility of the customer. Any warranty-related issues within the initial 30-day period will only be covered for the deductible incurred. It is the Buyer's obligation to enroll the puppy within 24 hours of acquisition with Trupanion to activate this complimentary coverage.

This dog must undergo spaying or neutering before reaching 12 months of age. Failure to comply with this requirement will result in the voiding of the health warranty. Proof of spay/neuter must be furnished to Dos&CoKennels within 30 days of the procedure being completed to maintain warranty eligibility. Failure to spay or neuter the dog by 13 months of age will necessitate the purchaser paying the Seller five times the purchase price. Any request for warranty reimbursement must be accompanied by proof of spaying/neutering by 12 months of age. The puppy is sold exclusively as a family pet and does not confer breeding rights. Breeding the puppy without authorization obligates the purchaser to compensate the Seller ten times the purchase price for each resulting litter. The purchaser assumes responsibility for all legal fees associated with enforcing this contract.

Dos&CoKennels offers an extension of the genetic defect warranty for an additional two years beyond the period.


Under no circumstances shall the Seller be liable to the Buyer or any third party for a dog subjected to abuse, accident, negligence, or misuse. Furthermore, the Seller bears no responsibility for any consequential incidental or special damages arising directly or indirectly from the dog.


Upon execution of this contract, all veterinary care and associated costs become the sole and exclusive responsibility of the Buyer.


CONSIDERATION


The dog described in Section 1 is sold for the sum of $ , payable in full upon execution of this contract. In the event that said funds are not immediately collectible by the Seller (e.g., due to a bank's refusal to honor a check tendered by the Buyer for the dog), the parties agree that the Seller is entitled to recover from the Buyer all reasonable attorneys’ fees and court costs incurred in securing full payment.


MAINTENANCE


The Buyer agrees to maintain the dog in good health and provide preventative health care, including but not limited to, inoculations, deworming, and heartworm preventative medication as indicated. The Buyer acknowledges that the Goldendoodle will be kept indoors, fed a quality diet, and maintained at a healthy weight. The Buyer further agrees to postpone strenuous, repetitive exercises (e.g., agility training or excessive running) until the dog reaches a minimum of one year of age. Basic obedience training is to be commenced within the first year of ownership. Under no circumstances shall the Buyer place the dog in a shelter, pound, research laboratory, or similar facility. The use of oral flea and tick preventatives voids the warranty entirely, in accordance with FDA warnings regarding their potential neurological effects in dogs. The use of ProHeart 6 and other injectable heartworm preventatives similarly nullifies the warranty.


CONFIDENTIALITY OF DISPUTES


In the event of a dispute between the Buyer and Seller, both parties agree not to disclose the existence or details of such dispute in any media or forum, including social media. This provision, however, shall not preclude either party from pursuing legal action or engaging in confidential mediation.


FULL AND FINAL AGREEMENT


The parties affirm that this document constitutes the entire Agreement between them, superseding any prior oral or written representations regarding the described dog. No modifications to this contract shall be binding unless made in writing and signed by both parties.


The Buyer confirms full comprehension of this contract, and both parties agree that this agreement is governed by the laws of the State of Illinois, with Cook County as the designated venue for any legal proceedings.

Guardian Home Contract

This agreement is entered into between Dos&CoKennels, hereinafter referred to as the "Seller," located in Chicago, Illinois, and:


The undersigned party, hereinafter referred to as the "Buyer."


It is hereby mutually agreed upon by the Seller and Buyer as follows:

**TO QUALIFY FOR OUR GUARDIAN HOME PROGRAM, YOU MUST:**


1. **I agree to** reside within 90 minutes of Chicago, Illinois and be flexible for dropping off and picking up the dog for health testing, vet visits, breeding, and whelping.
